TERMS AND CONDITIONS OF GENOMIC TESTING SERVICES

These Terms and Conditions (“Agreement”) govern the order and use of genomic testing services (the “Services”) provided by VetOmics, LLC (“Company”, “we”, “us”, or “our”) to clients (“Client”, “you”, or “your”). By submitting a specimen or otherwise engaging our Services, you agree to the following terms:


1. Services Provided

1.1 Genomic Testing: The Services include genetic sequencing, analysis, and reporting of specified biological samples (e.g., FFPE, FNA, fresh frozen tissue, or blood) for the purposes of detecting genomic alterations that are associated with treatment, diagnosis, prognosis and predisposition.

1.2 Results Interpretation: We will provide a detailed report summarizing the findings from the genomic analysis, including identified genomic variants, clinical interpretations, and potential therapeutic recommendations where applicable.


2. Client Obligations

2.1 Specimen Submission: You agree to submit samples in accordance with the instructions provided by VetOmics. You are responsible for ensuring the quality and proper handling of the specimen.

2.2 Authorization and Compliance: You represent and warrant that the submission of any samples complies with all applicable local, state, and federal laws, and that you have obtained any required patient consent or authorization to perform the test.


3. Use of Results

3.1 Clinical Decision Making: The genomic report is intended for use by qualified veterinary or medical professionals. It should not be used as a sole basis for clinical decisions, and it is intended to supplement, not replace, professional judgment.


4. Limitations of the Services

4.1 Diagnostic Limitations: While we strive to provide accurate and comprehensive genomic insights, genomic testing may not detect all mutations or variants relevant to a patient’s condition. VetOmics makes no guarantees regarding the accuracy or clinical utility of the test results in any specific case.

4.2 Therapeutic Recommendations: Any therapeutic recommendations based on the genomic report are for informational purposes only. It is important to understand that the recommendation of any therapy does not guarantee a treatment response and improved outcome for the individual patient. Final decisions regarding treatment should be made by licensed veterinary or medical professionals. VetOmics disclaims any liability for treatment decisions made based on the information contained herein.


5. Pricing and Payment

5.1 Fees: The fees for the Services are as indicated on our website or order form at the time of the transaction. All payments must be made in full before the analysis begins unless otherwise agreed upon in writing.

5.2 Refunds: Due to the personalized nature of genomic testing, no refunds will be provided once the test has been processed. Refunds or resampling may be considered if the test cannot be completed due to factors beyond your control, such as poor sample quality.


6. Confidentiality and Data Privacy

6.1 Confidentiality: All personal data and sample results will be treated as confidential. We will not disclose personal information or test results to third parties without your express consent, except as required by law.

9.2 Disclaimer: The Company is not responsible for any misinterpretation or misuse of the test results by third parties, including healthcare providers, clients, or other institutions.


10. Limitation of Liability

VetOmics shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services, including but not limited to loss of data, revenue, or profits, whether or not advised of the possibility of such damages.


11. Governing Law and Dispute Resolution
